Acceptance of Terms

These Terms of Service ("Terms") are a legal agreement between you and QuizBooth ("we", "us"). They apply when you visit quizbooth.games, create an account, build or publish a trivia game, play a quiz, or purchase activation credits.

By using QuizBooth you agree to these Terms and to our Privacy Policy. If you are using the service on behalf of a company or another organisation, you confirm that you have authority to bind that organisation to these Terms. If you do not agree, please do not use the service.

Use of the Service

QuizBooth lets you generate trivia games from the details you supply, share them by link or QR code, and collect scores and optional player information. You may use the service only for lawful, legitimate business purposes and in line with these Terms.

• Do not misuse the service. You must not attempt to gain unauthorised access to accounts, data, or systems, probe or bypass our security measures, or interfere with the operation or availability of the service.
• Do not copy or resell it. You must not scrape, bulk-download, resell, sublicense, or otherwise provide the service to third parties as your own, except as part of a quiz you are authorised to run.
• Do not reverse engineer it. You must not decompile, disassemble, or otherwise attempt to derive the source code of the service, except where the law expressly permits it.
• Keep content lawful. You must not use QuizBooth to create or share content that is unlawful, defamatory, infringing, hateful, harassing, or misleading, or to collect player information for spam.
• Play fair. You must not use bots, automation, or score tampering to manipulate leaderboards, results, or the experience of other players.

Accounts and Responsibilities

Creators sign in with Google through Firebase Authentication. Players do not need an account to join a quiz, though they may enter a display name and, optionally, an email address to save a score.

You are responsible for everything that happens under your account and for keeping your sign-in method secure. If you believe your account has been compromised, contact us promptly at contact@quizbooth.games.

• Accurate information. Provide accurate account and billing details and keep them up to date. You may not share one account between multiple people.
• Creator responsibility. You are responsible for the quizzes you create, including their questions, images, prizes, and any player information you collect, and for having the rights and consents needed to run them.
• Eligibility. You must be at least 18 years old (or the age of majority where you live) to create an account and purchase activation credits. Players must be old enough to take part lawfully, and a parent, guardian, or event organiser must supervise younger players.

Payments and Billing

QuizBooth sells one-time activation credits that unlock a quiz for an event. Prices are shown in US dollars on quizbooth.games/pricing and may change; the price displayed at checkout is the price that applies to your purchase.

Creem acts as our payment processor and merchant of record for every purchase. Your payment is processed by Creem under its own terms and privacy policy, and Creem handles applicable sales tax or VAT and issues the receipt. We never receive or store your full card details.

Activation credits do not expire. A purchase is complete, and credits are granted, when our server receives Creem's signed confirmation of the order — not when you return from the checkout page.

• Refunds. Refunds are governed by our Refund Policy, published at quizbooth.games/refund-policy, together with any rights you have under applicable consumer law.
• Failed or reversed payments. Credits are not granted if a payment fails, is reversed, or is refunded. We may suspend credits while a payment or chargeback is under investigation.
• Billing questions. Contact us at contact@quizbooth.games if a charge looks wrong. Because Creem is the merchant of record, some requests — such as a receipt or a payment-method update — must be handled through Creem support.

Intellectual Property

The QuizBooth name, logo, website, software, and all materials we create to operate the service are owned by NakNick or its licensors and are protected by intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable, revocable right to use the service for its intended purpose. No other rights are granted, and all rights not expressly given are reserved.

You keep ownership of the content you submit — company details, quiz titles, questions, images, custom logos, and prizes. By submitting it, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and distribute that content only as needed to operate the service and show your quiz to players.

AI-generated questions may resemble content generated for other customers and may not be unique. You are responsible for reviewing every question, image, and prize before you publish a quiz, and for making sure your use of the material does not infringe anyone else's rights.

• Player submissions. Players (or their parents or guardians) keep ownership of what they submit. By submitting a name, email address, or answer, a player allows it to be shown to the creator of the quiz and, where applicable, on a public leaderboard.
• Feedback. If you send us ideas, suggestions, or feedback, we may use them without restriction or compensation to you.
• Our marks. You may not use the QuizBooth or NakNick names or logos in a way that suggests endorsement or partnership without our prior written permission.

Disclaimer of Warranties

QuizBooth is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from a course of dealing or usage of trade.

We do not warrant that the service will be uninterrupted, secure, or error-free, that data will never be lost, or that AI-generated questions will be accurate, complete, or suitable for your audience. You are responsible for reviewing quiz content before it is played and for keeping your own copies of anything you cannot afford to lose.

Limitation of Liability

To the fullest extent permitted by law, QuizBooth and NakNick will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities, arising out of or relating to your use of the service, even if we have been advised of the possibility of such damages.

Our total liability for all claims arising out of or relating to the service is limited to the total amount you paid QuizBooth for the service giving rise to the claim during the twelve months before the event that gave rise to it.

Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by our negligence, for fraud or intentional misconduct, or for any statutory consumer rights you have. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Termination

You may stop using QuizBooth at any time. Creators can delete their games, and the player submissions stored with them, from the dashboard.

We may suspend or terminate your access, with or without notice, if you materially breach these Terms, use the service unlawfully or abusively, fail to pay amounts due, or if we are required to do so by law. We may also discontinue the service or an individual feature; where practical, we will give reasonable notice so you can retrieve your content.

• Effect of termination. Your right to use the service ends, and your content may be deleted. Activation credits that remain unused at termination are handled in line with the Refund Policy and applicable law.
• Survival. Sections that by their nature should survive termination — including payments and billing, intellectual property, disclaimers, limitation of liability, and governing law — continue to apply after your access ends.

Governing Law

These Terms are governed by the laws of the jurisdiction in which NakNick has its principal place of business, without regard to its conflict-of-law rules.

Any dispute arising out of or relating to these Terms or the service will be brought before the courts of that jurisdiction. If the law where you live gives you the right to bring a claim in your local courts, or requires a different governing law, those rights apply instead.

Changes to These Terms

We may update these Terms as the service evolves. When we do, we will revise the date at the top of this page. If a change materially affects your rights, we will take reasonable steps to notify account holders before it takes effect. Continued use of QuizBooth after an update means you accept the revised Terms.
